IHC gives opportunity to India to appoint lawyer for Kulbhushan Jadhav

ISLAMABAD: The Islamabad High Court (IHC) has given an opportunity to India for appointing a lawyer for the arrested spy Kulbhushan Jadhav.

A larger bench of the high court headed by Chief Justice Athar Minallah, Justice Amir Farooq, and Justice Mian Gull Hassan Aurangzeb heard the case related to the appointment of defence lawyer for Indian spy Kulbhushan Jadhav.

Attorney General of Pakistan Khalid Jawed Khan and senior lawyer Hamid Khan appeared in the hearing as amici curiae, whereas, Makhdoom Ali Khan and Abid Hassan Manto recused themselves to assist to the court in the case.CJ IHC Justice Athar Minallah questioned AGP Khalid Jawed Khan regarding the progress in the case. He told the court that the foreign ministry contacted the India’s ministry for external affairs where the New Delhi expressed unseriousness over the matters related to Kulbhushan Jadhav.

The attorney general added that a representative of the Indian embassy had also been contacted in this regards, however, they showed unwillingness to appoint counsel for Jadhav. The Indian government blamed Pakistani authorities for not giving a meaningful consular access, said Khan.

He said the Indian government restricted itself to launch political statements against Pakistan and seemingly not worried for the sentence of Kulbhushan Jadhav nor it is willing to defend its spy in the case. The Pakistani authorities apprised Jadhav regarding the court directives besides passing an ordinance to give opportunity to the Indian spy for appointing a counsel, said attorney general.

Khalid Jawed Khan read the ordinance in the courtroom which stated that India had been sent a letter on September 4, 2020. In a response letter on September 7, 2020, India raised four objections against the ordinance passed by the Pakistan’s parliament; consular access to Jadhav; granting permission to appoint a lawyer from foreign country and taking up the issue of India’s sovereignty to appear in a Pakistani court.

He said that the Indian government had also blamed Pakistan for giving an impression to facilitate Kulbhushan Jadhav through the ordinance but the legal procedures were unclear. The Indian authorities have been responded that the court will clarify the legal procedures, he added.

India could contact the court for getting the related documents, however, their response shows unwillingness to run away from the legal proceedings against Kulbhushan Jadhav, said Khalid Jawed Khan.

“The federal government is asking for the appointment of a counsel for Kulbhushan, on the other hand, India is giving an impression for the violation of the verdict announced by International Court of Justice (ICJ). India has been given a full opportunity to appoint its representative in the court as Pakistan is willing to hold a transparent trial of Kulbhushan Jadhav.”

The IHC chief justice remarked that the amici curiae should assist to court regarding the previous rulings of the international court in the same genre of cases. The basic motive is to ensure a meaningful implementation of the ICJ’s verdict in the case, he added.

Justice Minallah remarked that India could contact directly to the court by filing a plea besides sending its representative in the case.

Later, the court adjourned the hearing till November 9.

Kulbhushan Jadhav has been in Pakistan’s custody following his arrest from Balochistan in a counter-intelligence operation on March 3, 2016. During the investigation, he confessed to his involvement in terrorist activities inside Pakistan that resulted in the loss of many precious human lives.

He also made important revelations about RAW’s role in sponsoring state terrorism in Pakistan.

The treason case against former premier Nawaz Sharif and other PML-N leaders was not filed at the behest of any state institution, the Lahore police explained in a statement Tuesday.

The treason case against former premier Nawaz Sharif and other PML-N leaders was not filed at the behest of any state institution, the Lahore police explained in a statement Tuesday.

The FIR at the Shahdara police station was registered on the complaint of a citizen named Badar Rasheed, according to a Lahore police spokesperson. It included the sections that the case merited.

The police would ensure the provision of justice in the case, the spokesperson added.

The FIR contains sections 120 (when two or more persons agree to do an illegal act), 120B (punishment of criminal conspiracy), 121 (waging or attempting to wage war or abetting waging of war against Pakistan), 121A (conspiracy to commit offences punishable by Section 121), 123A (condemnation of the creation of the State, and advocacy of abolition of its sovereignty), 124 (assaulting President, Governor, etc with intention to compel or restrain the exercise of any lawful power), 124A (sedition), 153A (promoting enmity between different groups, etc), 153 (wantonly giving provocation with intent to cause riot) and 505 (statements conducing to public mischief) of the Pakistan Penal Code, as well as section 10 of the Prevention of Electronic Crimes Act 2016.

Senior PML-N leaders Shahid Khaqan Abbasi, Raja Zafarul Haq, Ahsan Iqbal, Pervaiz Rasheed, Khawaja Asif, Ameer Muqam, Khurram Dastagir, Marriyum Aurangzeb, Ayaz Sadiq and others have been nominated in the FIR too.

The Lahore police denied rumours suggesting that the FIR was lodged at the behest of the state or any of its institutions.

The clarification by the Lahore police came after Science and Technology Minister Fawad Chaudhry tweeted that the prime minister was unaware of the complaint and expressed his displeasure over it.

“Prime Minister Imran Khan was unaware of any such FIR, when I informed him about it, he expressed extreme displeasure,” Chaudhry tweeted.

But PML-N leader Rana Sanaullah believes that PM’s displeasure over the case was not enough.

“What action did the prime minister take against the ones who registered the case,” Sanaullah asked. “Just a tweet by Fawad Chaudhry does not make things right.”

The complainant, Badar Rasheed, has also contested election for the union council chairman seat on PTI’s ticket.

He has had multiple cases registered against him for possessing firearms, drugs, intervening in government affairs and attempted murder.

Sector G-12 a safe haven for drug pushers, robbers

DNA

ISLAMABAD: Amidst the fully developed sectors of Islamabad lies Sector G-12, known locally as Mehra Abadi. The thousands of acres of land occupied by the locals has become a ‘No Go Area’ for many since the illegal encroachment, construction of commercial and private property and other criminal activities continue unabated.

So much so, the said sector has become haven for the drug pushers; addicts and anti-social elements. As alleged by the residents living in the nearby sectors, people hiding in G 12 commit robberies and disappear in this sector. They also allege, police unfortunately either has not access to this sector or do not want to purge the Aegean stables.

The badly affected segment happens to be the youth in this case since many schools are located around the area. The drug pushers penetrate into these schools; lure young lads and thus make them addicts. This practice regrettably continues since long.

The resident living nearby have time and again registered their complaints wither with the local authorities or on Prime Minister Portal but nothing significant has been done so far and consequently illegal practices remain in operation.

The proposed Sector G-12 is an anomaly in an otherwise well-planned, well-developed and CDA maintained capital city. The civic agency had acquired the land from locals but for past three decades it has failed to take possession.

Although the award for G-12 land was given back in 1986, the local residents didn’t accept the terms and condition and refused to vacate. In the 1990’s and 2000’s multiple anti-encroachment operations were undertaken by CDA with assistance from Police and District Administration with little or no substantial results.

Also, due to the illegal occupancy by locals, sectors like G-13, G-14, F-14 and housing society near motorway are connected to mainland Islamabad with only one road, the Kashmir Highway. No service road and inter-sector roads exist.

Meanwhile, during past decade many shops, showrooms, marriage halls, marquees and other structures have been erected in and around the disputed sector. Since the land is not regulated under the domain of CDA, the sale and purchase of land is done through stamp papers. The absence of regulations and rules has made sector G-12 a safe choice specially for middle sized businesses like supply, hardware, car wash, cement etc.

It is pertinent to mention that sector G-12, the long disputed sector of Islamabad for the past two decades, is witnessing unbridled infrastructure development on its fringes. One can witness the development along the Kashmir Highway while entering and leaving Islamabad. Dozens of shops, marriage halls, marquees and showrooms can be spotted along the borders of G-12. Few months ago the district administration and CDA launched a massive operation to remove these encroachments, and they were able to remove some, however after strong resistance from the local the operation was left in half way.

On papers, CDA had acquired the sector back in 1985, however, the locals refused to give possession as they found the compensation to be insufficient. The sale and purchase of land in the sector has been barred since then. At present, many businessmen and property dealers are selling and purchasing the land in the sector. The sales and purchases are being done without a lawful transfer of title, allocation of a plot on the map and registry.

Due to the rampant urbanization along the Kashmir Highway during last few years, the mushrooming of restaurants and marquees in the area initiated a new trend of connecting the building structures with main Kashmir Highway. This practice has also resulted in severe accidents in addition to creating traffic woes.

CDA officials say that the issue of G-12 has multiple dimensions. ‘They (the locals) have taken their case to the court and bagged stay orders. In that situation the hands of the CDA are tied.
