Nawaz clears another legal hurdle in way of elections, secures acquittal from IHC in Al-Azizia case

Nawaz clears another legal hurdle in way of elections

ISLAMABAD, DEC 12: In yet another major relief for the PML-N, the Islamabad High Court (IHC) on Tuesday acquitted PML-N Supremo Nawaz Sharif in the Al-Azizia reference.

A two-judge bench comprising IHC Chief Justice (CJ) Aamer Farooq and Justice Miangul Hassan Aurangzeb announced the verdict, which was reserved earlier in the day, while hearing Nawaz’s appeal against his conviction in the Al-Azizia reference.

The same bench had acquitted the PML-N leader in the Avenfield reference on November 29.

The Al-Azizia Steel Mills corruption reference pertains to a case in which he was sentenced to seven years in jail on Dec 24, 2018. He was also fined Rs1.5 billion and US$25 million.

The reference pertains to the Sharifs being unable to justify the source of the funds provided to set up Al-Azizia Steel Mills and Hill Metal Establishment (HME) in Saudi Arabia.

The IHC had declared him a proclaimed offender in the case in December 2020. After leaving for London on medical grounds, Nawaz remained there for nearly four years and only returned to the country in October this year.

Soon after his return, Nawaz had formally filed two separate applications seeking restoration of his appeals against the conviction in reference.

In the application, the PML-N supreme leader had said that while he was abroad for medical treatment, the pending appeals were dismissed for non-prosecution. The application requested the court to revive the pending appeals to decide on these pleas on merit.

The IHC had on Oct 24 revived Nawaz’s appeals in the two reference.

At the previous hearing, the court had turned down the National Accountability Bureau’s suggestion that Nawaz’s conviction in the reference be set aside and the case be re-tried. It had also declared that it would decide the PML-N supremo’s appeal on merit.

Ahead of today’s hearing, Nawaz arrived in court along with senior PML-N leaders including Ishaq Dar and Azam Nazeer Tarar.

Today’s hearing
At the outset of the hearing, Nawaz’ lawyer Amjad Pervaiz came to the rostrum and told the court that he wanted to argue on the matter of Nawaz’s dependents.

However, IHC CJ Farooq pointed out that the PML-N lawyer had completed his arguments in the case. Pervaiz insisted that he wanted to argue on one point in this regard.

The court then asked whether NAB had proven anything related to Nawaz’s dependents. The lawyer responded that one of the witnesses, Wajid Zia, had admitted that there was no evidence pertaining to Nawaz’s dependents.

He said that there were several court verdicts present regarding the definition of benami. Pervaiz then presented 13 separate verdicts in benami cases. He contended that the legal team had also raised its objections in front of the trial court that convicted Nawaz.

He said that the trial court had relied on three major points. Nawaz’s lawyer said that the trial court had kept the civil miscellaneous applications filed in the Panama case as the basis.

“All three civil miscellaneous applications were filed by Maryam Nawaz, Hassan Nawaz and Hussain Nawaz,” he contended. He highlighted that not a single civil miscellaneous application was filed by Nawaz.

“In its judgement, the trial court held that the civil miscellaneous applications were criminal material,” the lawyer said. “Not a single application proves that Nawaz was the owner of these assets,” he said.

At one point, the IHC CJ asked about the contents of the civil miscellaneous applications. “The applications were not placed on record. Documents related to them were placed on record,” Pervaiz responded.

He reiterated that the applications did not state that Nawaz owned the assets, adding that they instead stated that the matter did not concern the PML-N supremo.

“It is a principle that evidence in one case cannot be admissible in another. Especially when the nature of both cases is separate,” he said.

Pervaiz further said that the trial court also relied on an interview given by Hussain Nawaz to a private TV channel in 2016. “Even though Hussain was saying in the interview that the matter did not concern Nawaz,” he said.

Nawaz’s lawyer further said that an accused was innocent until proven guilty. He said that the onus was on the prosecution to prove the charges against the accused. “The burden of proof is on the prosecution, not the accused,” Pervaiz said.

“The accused cannot be forced to prove his innocence,” he said. Nawaz’s lawyer said that there was no previous assets case where the accused was convicted without presenting clear proof of ownership.

“The prosecution could not present a single piece of evidence. Therefore, the the burden of proof cannot be transferred onto the accused,” he said as he wrapped up his arguments.

The NAB prosecutor then came to the rostrum and began his arguments. He said that a references were filed in accountability courts on the directives of the Supreme Court. He further said that a joint investigation team (JIT) was formed to probe the NAB references.

He said that the accountability watchdog conducted its own investigation. “In cases concerning assets, there are only two to three methods of investigation,” he said, adding that all the evidence collected was part of the record.

These also included statements recorded under Section 161 of the Code of Criminal Procedure, he said. He also read out loud some parts of Nawaz’s indictment.

“Al-Azizia and Hill metal are the two prime allegations. Tell us when the Al-Azizia allegations were brought,” asked the IHC CJ. “You were the prosecutor. Tell us what evidence you possessed. Tell us on what basis you transferred the burden of proof onto the accused,” he said.

“Leave the law. We have the read the laws. Come straight to the prosecution,” the IHC CJ told the NAB lawyer. “Is there any evidence on record? Is there any witness present?” he asked.

The NAB lawyer said that Nawaz was indicted on charges of corruption and corrupt practices. Witnesses from the Securities and Exchange Commission of Pakistan (SECP) and the Federal Board of Revenue (FBR) were presented in court, he said.

“This is a case of white collar crime,” he said. He further said that evidence was collected from across the country and said that letters were also written to collect evidence from abroad.

Dr. Maen KHREASAT: Jordan’s relationship with Pakistan is historic and strong

Interview of Dr. Maen KHREASAT Ambassador of the Hashemite Kingdom of Jordan to Pakistan

Ansar Mahmood Bhatti

Your Excellency! On behalf of “Centerline Magazine”, “Islamabad Post” newspaper and “Diplomatic News Agency” I wish to welcome you as the new Ambassador of the Hashemite Kingdom of Jordan in Pakistan, and also to appreciate your efforts for enhancing the bilateral relations between Pakistan and Jordan. I am also thankful to you for giving us time out of your busy schedule.

1:      Let us first start with your personal impressions about Pakistan as this is your second posting, now as an Ambassador in Pakistan?

Good morning Mr. Bhatti and welcome to the Embassy as an old and dear friend. I wish to thank you and “Centerline Magazine” for giving me this opportunity to highlight few important points concerning my previous experience in Pakistan and the bilateral relationship between Jordan and Pakistan.

It is both a pleasure and an honor to serve my country in a very dear brotherly and friendly country. Jordan’s relationship with Pakistan is historic and strong. I am a career diplomat where I served in many capitals before including Ottawa, Tokyo, Brussel, Tunis and last in Islamabad. As this is my first Ambassadorial mission abroad, I feel privileged to be here again. From day one, I was welcomed and extended all the courtesies and high attention by the esteemed Government of Pakistan to make my mission a successful one. On a personal level, the warmth and hospitality of the Pakistani people is quite amazing and beyond description.

Pakistan is a beautiful, rich and important country in South Asia and the Muslim world. It has undoubtedly played, and still playing, a pivotal role in the world affairs and has always been a voice for peace and stability. My previous experience in Islamabad, both official and personal, enabled me to advance my career and enjoy what this brotherly country has to offer, and it is a great honor for me to be back as the Ambassador of Jordan in Islamabad.

In God’s well, I intended to carry out my duties to enhance the economic and trade bilateral exchange up to a higher level to match the highly strong political and military cooperation.

2:      How would you describe the bilateral relations between Pakistan and Jordan especially in the fields of trade, economy and culture? Tourism is yet another area where both countries can boost cooperation. Please share your vision as to how engagement in this particular sector can be intensified?

I will work with my Embassy team on two levels. The first is to present higher visibility of Jordan in Pakistan by taking part in conferences, exchange with think tanks, public cultural events, and reinforce the ties between cultural bodies and Universities. Secondly, by building a cultural human bridge throughout higher education exchange and encouraging Jordanian students to study in Pakistani Universities and visa versa. I am a strong believer of People-to-People relationship which further strengthens the official and business bilateral ties.

On the trade and investment front, I find that we need to do more to bring together our business community and Chambers of Commerce & Industry. Both economies provide for genuine business opportunities. For example, Jordan is a leading world exporter of Phosphate fertilizers and Potash. We can add to this the unique Dead Sea products in cosmetics. Jordan also is a leading Middle East manufacturer and exporter of pharmaceuticals. I encourage Pakistani business community to visit Jordan and experience the suitable business climate, especially that Jordan has Free Trade Agreements with leading economies in the world to enable Jordanian exports to penetrate smoothly into these huge markets. I estimate that the exchange of business delegations will tremendously help to explore the opportunities and form closer ties between the business community on both sides. For Pakistan, there is an enormous potential in agriculture and food industries, cattle and livestock, leather and leather manufactured products, military hardware, and IT sector.

Tourism also is a main attraction to visit Jordan and explore the ancient history of the country and visiting the wonders of Jordan in Petra the red-rose city, the Dead Sea unique environment, Prophets and Maqamat Essahabah the Companions of the Prophet Mohammad (PBUH). In addition, Health Tourism is considered yet another attraction to visit the country and benefit from the state-of- the art medical services provided for by the private sector.

3: Both countries have also been engaged in political consultations with a view to further strengthening and deepening brotherly ties. If you can share some details, please?

We have an established mechanism for political consultations between our Foreign Ministries, where we conducted the first meeting on the level of Foreign Secretaries in Islamabad in 2016. We are looking forward for the 2nd meeting to take place in Amman during 2024.

On a higher level, our communications and discussion continue regularly between our Leadership on important matter, and on the level of Foreign Ministers, Jordan and Pakistan coordinate bilaterally and in multilateral forums especially in the United Nations.

Another important mechanism and milestone is anticipated in 2024, namely, the 10th Joint Ministerial Commission JMC in Islamabad. The convening of this important meeting with serve as a platform to review our trade and bilateral relations and serves as a catalyst to strengthen this cooperation including signing new agreements and MoUs to enhance the already important and cordial bilateral relations.

On the Military cooperation field, this is considered to be the Gewl of our partnership. The Joint military committee convenes annually to review and advance this important cooperation and set up for future collaboration. In addition to the training and officers’ courses, and joint and multilateral military exercises with friendly countries, we regularly exchange High Level visit between the two Armies and Forces. Having no doubt, since independence Jordan and Pakistan have shown steadfast commitment to each other’s security and mutual support and solidarity in critical moments. This is the Pride of our relationship.

4: Your Excellency! Jordan has been repeatedly referred to as an “Oasis of Stability” in a turbulent region. It has been mostly unharmed by the violence that swept the region. Which factors you think keeps the Hashemite Kingdom of Jordan away from these kinds of violence?

To name a few we can mention:

  • The Moderation of the Hashemite Leadership (Al Albayt), where HM King Abdullah Ibn Al Hussein is the 41st decedent of the Prophet Mohammad (PBUH). The leadership exemplifies moderate Islam in its best ways and stands steadfast against fanaticism and radicalization. HM King Abdullah is the Custodian of the Holy sites in Jerusalem (both Muslim and Christian)
  • Jordan has always called for a just, permanent and comprehensive settlement of the Palestinian Problem that leads to self-determination for the Palestinian people and the establishment of an independent, viable and contiguous Palestinian State with east Jerusalem as its capital. In addition, Jordan has played a pivotal role in the Middle East Peace Process to achieve the goal of statehood to the Palestinians and is the first host of Palestinian refugees community outside Palestine.
  • Tolerance, harmony and peaceful co-existence between the different ethnic and religious components of the Jordanian society has significantly supported the unity of the people.

5: What is the role of the Hashemite Kingdom of Jordan to maintain peace in the region because if stability occurred in the Middle East region then Jordan would be the one of the directly beneficiary country in the region?

  • As discussed earlier, Jordan is playing an important role to stabilize the region and to alleviate the suffering of the Palestinian people and other innocent victims of conflicts.
  • On the political level, the steadfastness of the Jordanian leadership towards peace is unequivocal. This commitment stems from the conviction that only a just and lasting peace based on international legitimacy would bring stability and prosperity to all peoples of the region, and Jordan is committed to support a negotiated peace settlement to the Palestinian-Israeli conflict.

I wish to thank you again, dear Mr. Bhatti, for this opportunity and for visiting the Embassy, and looking forward to maintain this friendship for the benefit of our two Nations.

“Colours of the ICE” reflects the artistic value of glaciers

“Colours of the ICE” reflects the artistic value of glaciers

The Italian government has always been out to support initiatives regarding research, science, conservation and development: Andreas Ferrarese

Abid Raza/DNA

Islamabad – A three-day exhibition of photos and paintings entitled “The Colours of the ICE” kicked off at the Pakistan National Council of the Arts (PNCA) on Monday in connection with the 13th edition of Pakistan Mountain Festival, the annual flagship event of Devcom-Pakistan to mark the International Mountain Day that falls on December 11.

The exhibition included 21 large-size photos reflecting the colours and textures of the glaciers in the north of Pakistan, 40 photos of the Boltoro cleanup, 12 paintings of Himalayan Odyssey series by Raja Changez Sultan, and some paintings by the students.

Italian Ambassador Andreas Ferrarese was the chief guest on the occasion. Speaking on the occasion, he said the mountains play a key role in life on the planet. The Italian government has always been out to support initiatives regarding research, science, conservation and development.

He appreciated the role of the Italian Agency for Development Cooperation, EvK2CNR, UNDP and IUCN for their relentless efforts to empower mountain stakeholders to conserve the local resources.

The Ambassador said mountains are host to about half of the world’s biodiversity hotspots. They are water towers of the world, and supply freshwater to an estimated half of humanity. Mountains are home to an extraordinary range of plants and animals, and to many culturally diverse communities with different languages and traditions. From climate regulation and water provisioning services, to soil maintenance and conservation, mountains are key to our lives and livelihoods.

Samuel Rizk, the country representative of UNDP Pakistan, said mountains and its natives have become more vulnerable in the changing climate. Mountain regions are complex in their geomorphology and therefore more vulnerable to variations in temperatures and changes in patterns of hydrology. Both have a direct impact on mountain communities, adding fragility to lives already clinging tenuously to eco-systems for sustenance.

Gigit-Batistan Secretary Finance Aziz Ahmad Jamil while appreciating the contribution of the development partners said Gilgit-Baltistan (GB) covers over 72,000 square kilometers, also housing the world’s highest mountain range. It has a large potential of hydro and biodiversity too, but resource starved GB region always looks for development partners’ support to harness the potential of its resources. Much wonderful work is done by the partners for the communities and much has to be done.

Maurizo Gallo said glaciers are alive, they move, change, and evolve. They have sounds and colours. The artistic project reveals to us the “Colors of Ice” as seen through the eyes of nature, science, and art. In addition to the satellite photographs documenting the glacier, AI-generated images are used to reprocess scientific data, introducing new colors to the ice that display its boundaries, temperature, melting and future scenarios. The exhibition “The Colors of the Ice” is ultimate interpretation of an artist’s sensitivity in the photographs taken inside the glacier.

AICS representative, Jacopo Branchesi mentioned their project activities in Pakistan in the sector of mountain conservation, livelihood and tourism.
