Constitutional bench dismisses plea challenging extension in army chief's tenure

ISLAMABAD, NOV 19: A seven-member Supreme Court constitutional bench on Tuesday dismissed a petition challenging the extension of the tenure of the army chief.

Justice Amin-ud-Din Khan-led bench rejected the petition over non-pursuance, whereas, the SC registrar office’s objections regarding the plea being inadmissible were also maintained.

The SC bench also includes Justice Ayesha Malik, Justice Muhammad Ali Mazhar, Justice Hassan Azhar Rizvi, Justice ⁠Jamal Khan Mandokhail, Justice Naeem Akhtar Afghan and Justice Musarrat Hilali.

The development comes as the ruling coalition, earlier this month, amended the laws — via the Pakistan (Army/Air Force/Navy) Act Amendment, 2024 — that dealt with all three branches of the armed forces, extending the fixed tenure of services chiefs up to five years.

Regarding the retirement age and service limits of services chiefs, including chief of army staff (COAS), chief of naval staff (CNS) and chief of air staff (CAS), the bill read that the criteria prescribed for the senior military officers “shall not be applicable” to the army, navy and air force heads during their “tenure of appointment, reappointment and/or extension”.

The government also amended Section 8C, which deals with the retirement age, which is 64 years, and service limits of service chiefs.

Multiple FIRs on one incident
The bench also held a hearing on a case involving the registration of two first information reports (FIRs) for a single incident.

During the proceedings, the court declared the petition inadmissible and subsequently dismissed it.

Justice Mandokhail highlighted that cases like these have significantly contributed to the backlog of 60,000 pending cases in the judiciary.

He also remarked that the court is repeatedly reminded of this mounting number and questioned why the petition should not be dismissed with a penalty.

Addressing the petitioner, who is a lawyer by profession, Justice Mandokhail criticised the filing of such cases.

Meanwhile, Justice Mazhar referred to the Sughran Bibi case and noted that the court had already ruled on the matter.

He further questioned the petitioner on why they had not approached the High Court to seek the dismissal of the second FIR.

Transfer of cases to regular bench
A three-member bench, led by Justice Mansoor Ali Shah, had transferred two cases from the regular bench to the constitutional bench.

However, during the hearing today, the seven-member constitutional bench decided to transfer the cases back to the regular bench.

During the proceedings, Justice Ayesha clarified that the petitioner’s lawyer had requested the case be sent to the constitutional bench, and it was done at their behest.

Justice Mazhar expressed that not every case should be sent to the constitutional bench, suggesting that cases involving constitutional questions should be the exception.

In a related development, a case concerning a housing society was also transferred back from the constitutional bench to the regular bench. Justice Ayesha noted that cases often shift from one bench to another, highlighting the complexities involved in such transfers.

The lawyer for the opposing party had requested that the case be referred to the constitutional bench, though the petitioner’s lawyer, Salman Aslam, clarified that they had not made such a request.

ISLAMABAD: The Islamabad administration on Monday imposed Section 144 for two months ahead of the potential Pakistan Tehreek-e-Insaf’s (PTI) protest in the capital.

According to a notification issued by Additional District Magistrate Usman Ashraf, the ban has been placed on all public gatherings of five or more people, processions, rallies and demonstrations.

The authorities said the decision has been taken in view of law and order situation, citing concerns about potential unlawful assemblies, disruption of public order and the current security environment.

The order specifically mentions concerns about planned religious and and other demonstrations in the federal capital, said the notification.

The ban prohibits gatherings in all public places within Islamabad’s revenue limits, encompassing the area defined as the Red Zone which includes key government buildings, diplomatic missions and other sensitive locations.

The order states that even after the two-month period expires, any ongoing investigations, legal proceedings or penalties related to violations of the ban will continue.

The development comes in light of the Imran Khan-founded party’s planned countrywide demonstration on November 24.

The former prime minister had called on his supporters to march to Islamabad, stressing that the party’s entire leadership will be part of the protest.

Khan’s lawyer, Faisal Chaudhry, said that the protest would not only take place in Islamabad, but throughout Pakistan and across the world where Imran’s supporters were present.

The party has made four demands — revoke the 26th Constitutional Amendment, “restore” democracy and Constitution, return the public’s mandate, and release all “innocent political” prisoners.

The lawyer said that the party founder had also formed a committee for the march and asked not to reveal the names of those who were part of it as Imran feared they would be arrested.

Khan has been behind bars since August 2023 after he was booked in several cases ranging from corruption to terrorism.

ISLAMABAD, NOV 18 /DNA/ – Today at the “Together We Build” celebration at the National Council of the Arts in Islamabad, the United States and Pakistan commemorated seven decades of collaboration in infrastructure development.  The event highlighted transformative projects supported by the United States that have connected communities, strengthened local economies, and improved the lives of millions of Pakistanis.

Since 2005, the United States, through the United States Agency for International Development (USAID), has invested nearly $2 billion in infrastructure projects across Pakistan. These efforts include modernizing the Tarbela and Mangla Dams, establishing premier institutions like the Institute of Business Administration (IBA) Karachi and the Lahore University of Management Sciences (LUMS), and constructing or rehabilitating 345 schools. U.S. investments have also expanded healthcare access, rehabilitated and equipped facilities such as Jinnah Postgraduate Medical Centre (JPMC), Jacobabad Institute of Medical Sciences (JIMS), a state-of-the-art burn and trauma center in Peshawar, and multiple health centers.

Speaking at the ceremony, U.S. Ambassador Donald Blome highlighted the U.S. approach to development, which  focuses on creating jobs investing in local communities, and providing services directly to the people.  “Our goal is to ensure that infrastructure investments directly benefit the people of Pakistan and promote long-term sustainability,” he noted.

The Ambassador underscored that the United States provides development assistance through grants, not loans, with no need for repayment.  He reaffirmed that creating opportunity and prosperity for the Pakistani people will remain a central feature of the enduring partnership between the United States and Pakistan.

TASHKENT, NOV 18 (DNA) – The first session of the Legislative Chamber of the Oliy Majlis (Parliament) of the Republic of Uzbekistan after the elections was held in Tashkent.

It was attended by President of the Republic of Uzbekistan Shavkat Mirziyoyev. The session was opened by Chairman of the Central Election Commission ZayniddinNizamkhodzhaev.

The National Anthem of the Republic of Uzbekistan was played. Temporary Secretariat of the first session, Counting Commission and temporary group on control over the use of electronic vote counting system were elected. The agenda was approved. The CEC Chairman presented information on the results of the elections to the Legislative Chamber.

On the proposal of the Council of Representatives of Political Parties, deputies elected Nuriddin Ismoilov to the post of Speaker of the Legislative Chamber of Oliy Majlis by secret ballot.

Then the chairmanship of the session passed to the Speaker. Deputy Speakers were elected. The factions of five political parties were registered. Ten committees of the Legislative Chamber were established in accordance with their agreed proposals.

President of Uzbekistan Shavkat Mirziyoyev addressed the session.

At the beginning of his speech, the Head of State congratulated the deputies on their election, emphasizing that this is the embodiment of high trust and respect of our people.

It was emphasized that the current parliamentary elections have entered the history as being the first ones held in accordance with the updated Constitution. This process was conducted for the first time under a mixed electoral system.

As a result of the elections, 150 deputies were elected to the Legislative Chamber. Among them were 57 women and 11 young people under 35 years of age. Overall, the composition of the lower house was renewed by almost 60 percent.

The activities of the Chamber over the past five years were discussed. During this period, the Constitution has been updated and more than 130 new laws have been adopted, which is 1.5 times more than in the previous period.

The President also drew attention to the issues that remained out of parliamentary attention. For example, the share of laws with direct action and clear enforcement mechanisms remains low. Parliamentary and deputy control is still not effective enough. The activity of deputies in constituencies is mostly limited to organizing meetings, answering complaints and questions.

The Head of State outlined his vision of the new tasks ahead of the Legislative Chamber.

In particular, it was proposed to create public councils under each committee with the participation of representatives of civil society to strengthen the dialogue.

It is important to establish not only control and requirements in the work of parliamentary committees, but also close cooperation with ministries. It is also necessary to strengthen party and fractional discipline.

The President emphasized that lawmaking, primarily, should be aimed at solving urgent problems of society, and put forward a number of legislative initiatives. Among them are the construction of modern residential buildings replacing outdated ones, guaranteeing the protection of citizens’ funds allocated for housing construction, support for private education and investors in the energy sector, introduction of compulsory health insurance, creation of a legal framework for franchising, capital market and startups, and relations arising in the field of artificial intelligence.

In order to boost the opposition, it was proposed to increase the number of guaranteed rights of the parliamentary opposition from 3 to 6, including giving it the positions of one committee chairman and two deputy committee chairmen, as well as additional rights to submit questions within the framework of the “government hour” and parliamentary inquiries.

Particular attention was paid to the need to transition to a system of broad, high-quality parliamentary control. In particular, in accordance with the updated Constitution, the control over the execution of the State Budget is the exclusive competence of the Legislative Chamber. In this regard, it is necessary to strengthen the work of the Chamber in this direction, including the introduction of the practice of submitting all reports of the Government on the State Budget to the Chamber only together with the audit report provided for by the Budget Code.

– A deputy is a servant of the people, a model for all, a person with a high level of political culture and knowledge, who sincerely loves his homeland. Our people, all of us, above all rely on you to strengthen peace, mutual understanding and harmony in the family, mahalla and society, to educate the youth in the spirit of patriotism, to defend the interests of Uzbekistan in the international arena, – said Shavkat Mirziyoyev.

Heads of political party factions and deputies addressed the session. The President supported their views, urged the deputies to work harder and be closer to the people.

– The voice of a deputy is the voice of the people. If you consider every issue concerning the fate of the country and first of all see our hardworking, generous and noble people in front of you, if you act thinking not only about today, but also about peace and happiness of future generations, then our people will be satisfied with you, – emphasized the Head of State.

ISLAMABAD: Eight teams are set to compete for the trophy in the Federal Female Club Basketball Tournament, which kicked off on Monday at Hamidi Hall, Pakistan Sports Complex, Islamabad.

The event is organized by Right to Play, in collaboration with Alliance Française, under the supervision of the Federal Basketball Association.

The opening ceremony, held with great enthusiasm, was graced by Federal Secretary for Education Mohiuddin Wani, who attended as the Chief Guest. Fabrice Disdier, representing Alliance Française, was the Guest of Honour. Also present were Ali Khayam, Country Director for Right to Play, and Ouj E Zahoor, General Secretary of the Federal Basketball Association. The event was further honored by the presence of the wife of the Ambassador of France, a former international basketball player, and the wife of the Polish Ambassador, both of whom showed their support for the young athletes.

ISLAMABAD, NOV 18 /DNA/ – Federal Minister for Finance and Revenue Senator Muhammad Aurangzeb held a virtual meeting with the Governor State Bank of Pakistan and Chairman Pakistan Banks’ Association (PBA) and their teams to discuss progress on financing for the priority sectors today.

Mr. Zafar Masud, Chairman of PBA, apprised the Minister on various initiatives planned by PBA for building an inclusive and sustainable financial ecosystem. He proposed that electronic warehouse receipt finance, SME index, corporate farming financing, venture capital fund for fintechs, revival of agri cooperatives and establishment of financial data exchange could be some of the potential initiatives to create a long-term impact towards a sustainable financial ecosystem. He also proposed initiatives such as fan financing, EV financing, solarization of tube-wells and markup subsidy and first loss coverage for SME financing for a short-term and more immediate impact on the system.

Mr. Jameel Ahmed, Governor State Bank of Pakistan, highlighted the progress achieved on various fronts in respect of various initiatives proposed by PBA for financing to priority sectors. He argued that some of the proposals suggested by PBA were concrete in scope and the central bank had already issued necessary notifications on regulatory side to facilitate their implementation. He also proposed a more proactive consultation between stakeholders, particularly with telecos and power companies, on initiatives requiring data collection and building scorecard for agriculture and SME sectors for sustainable financing.

Speaking on the occasion, Minister for Finance and Revenue Senator Muhammad Aurangzeb appreciated the work done by PBA and SBP for coming up with substantial initiatives and taking measures for implementing the more tangible initiatives.

He urged that initiatives with short term and immediate impact be given priority and their implementation timeframe be compressed for finalizing them by end December and hopefully rolling them out from early next year.

The Minister also assured full support for arranging necessary consultations between PBA/SBP and the stakeholder ministries, adding the Finance Division would also host a meeting of all relevant stakeholders to hear their viewpoints, and help forge a consensus on the proposed initiatives.

Ethiopia, Pakistan agree to enhance health sector cooperation

ISLAMABAD, NOV 18 /DNA/ – The Federal Democratic Republic of Ethiopia (FDRE) and the Islamic Republic of Pakistan on Monday explored various avenues of enhancing the bilateral cooperation in the health sectors, mainly joint efforts in research and development areas.

The discussion to enhance the cooperation took place during a meeting between H.E. Dr. Jemal Beker Abdula, Special Envoy and Ambassador Extraordinary of the FDR Ethiopia to the Islamic Republic of Pakistan, and Coordinator to the Prime Minister of Pakistan on National Health Services, Regulation and Coordination H.E. Dr. Malik Mukhtar Ahmed Bharath.

The meeting mainly focused on global health security, institutional linkages, exchange of researches on preventing and curing communicable diseases such as pandemics and outbreaks, medical and allied health professional education for Ethiopian students in Pakistan, and medical tourism.

H.E. Ambassador Dr. Jemal Beker highlighted the commitment of the Government of Ethiopia for ensuring health, safety and security by creating awareness on diseases, hygiene and environment-friendly issues that reduced maternal and child mortality, increased longevity, and wellbeing of the society.

He said Ethiopia is a 3rd diplomatic hub in the world, and recently established a state-of-the-art disease control center where joint researches are being conducted on different diseases especially the communicable ones.

The Ambassador also highlighted the strong attachment of Ethiopian students who studied from Pakistan, recalling their eagerness to help Pakistan during the flash floods 2022. “There is a strong need to invest in people-to-people relations to advance the bilateral relations to the high level,” he added.

He said there is a huge potential for the people of Pakistan to invest in the pharmaceutical and surgical sector of Ethiopia which imports a major chunk from various countries.

On the other hand, the Coordinator to the Prime Minister on National Health Services, Regulation and Coordination acknowledged Ethiopia’s friendly bond with the people of Pakistan, expressing strong commitment to strengthen Pakistan’s relations with Africa especially Ethiopia through Ethiopian Airlines.

He agreed to work closely with the Ethiopian Embassy Islamabad for initiating collaboration in research and development sector, and cooperation for exchange of research in health sector, and provision of medical and allied health professional education.
