Trump spared jail at hush money sentencing, days before inauguration

Pakistan hockey team not invited to Azlan Shah Cup 2025

Donald Trump avoids jail time or a fine but the US president-elect’s criminal conviction will be on his record.

News Desk

New York: Donald Trump has become the first former United States president ever sentenced for a crime, but the US president-elect avoided penalties for his conviction over hush-money payments made to an adult film actress.

Judge Juan Merchan sentenced Trump to an “unconditional discharge” on Friday, a day after the US Supreme Court rejected an attempt by Trump’s legal team to delay sentencing before the Republican leader’s inauguration on January 20.

The decision means that Trump’s conviction will appear on his permanent record, but he does not face imprisonment, a fine, or probation – leaving him unencumbered to enter the White House.

Trump, who previously served as president from 2017 to 2021, was found guilty in late May on 34 counts of falsifying business documents related to hush-money payments made to Stormy Daniels, among other things.

The US president-elect has denied any wrongdoing and said he plans to appeal his conviction.

Appearing virtually at Friday’s sentencing hearing, Trump said his criminal trial and conviction had “been a very terrible experience” and insisted he committed no crime.

“It’s been a political witch-hunt,” Trump said before the judge issued his decision. “It was done to damage my reputation so I would lose the election and obviously that didn’t work.”

Prosecutors in the New York case had argued that the hush-money payments aimed to conceal allegations of a sexual relationship with Daniels that could have been politically damaging.

The payments were made ahead of the 2016 US presidential election, which saw Trump defeat Democrat Hillary Clinton to win the White House.

Trump, who pleaded not guilty in the case, has denied any sexual relationship took place.

Reporting from Washington, DC, on Friday morning, Al Jazeera’s Alan Fisher said prosecutors had argued “it was important that Donald Trump was held responsible”.

“The judge himself said this was a unique and difficult case, but in the end, he decided that the sentence had to be an unconditional discharge,” Fisher said.

Under New York’s penal code, a court can sentence a defendant to an unconditional discharge if it “is of the opinion that no proper purpose would be served by imposing any condition upon the defendant’s release”.

Earlier this week, Trump’s lawyers had asked the Supreme Court to delay the sentencing “to prevent grave injustice and harm to the institution of the Presidency and the operations of the federal government”.

They argued that a ruling last year by the top court that grants presidents broad immunity from criminal prosecution means that some of the evidence should not have been presented in the case.

But a majority of the justices on the Supreme Court said in a decision late on Thursday that the “alleged evidentiary violations” at Trump’s state-court trial “can be addressed in the ordinary course on appeal”.

They also said “the burden that sentencing will impose” on Trump’s responsibilities “is relatively insubstantial in light of the trial court’s stated intent to impose a sentence of ‘unconditional discharge’ after a brief virtual hearing”.

Trump’s legal team is expected to appeal his conviction.

Now that he has been sentenced, Trump is free to pursue the appeal, a process that could take years and play out while he is serving his four-year term as president.

“Today’s event was a despicable charade, and now that it is over, we will appeal this Hoax, which has no merit, and restore the trust of Americans in our once great System of Justice,” Trump wrote on his Truth Social platform after his sentencing.

Mushaal Hussein Mullick slams India’s ‘Barbaric’ treatment of Hurriyat leaders

India's 'Barbaric' treatment of Hurriyat leaders

ISLAMABAD, Jan 10 (APP):Mushaal Hussein Malik, wife of veteran Kashmiri leader Yasin Malik Friday unleashed a scathing indictment of India’s brutal treatment of Hurriyat leaders in jails, slamming the Indian government for its egregious violations of international law and human rights and demanding justice for the Kashmiri people. Talking to PTV news channel, she emphasized that the torture and mistreatment of these leaders are a clear contravention of human rights and international law, highlighting the urgent need for the global community to take notice and act. Mushaal Malik expressed serious concerns about the deteriorating human rights situation in Indian Illegally occupied

Jammu & Kashmir.
She has repeatedly spoken out against India’s actions, including the revocation of Kashmir’s special status in 2019, which she termed as a “biggest violation of human rights”.
Mushaal Hussein Malik also strongly condemned India for torturing Hurriyat leaders, including her husband Yasin Malik, Aasiya Andrabi, Ashraf Sehrai, Shabbir Ahmed Shah and Syed Ali Shah Gilani, who have been subjected to inhumane treatment, including torture, poor living conditions and denial of medical care and legal aid in Indian jails.
Mushaal Hussein Mullick criticize Modi regime for its blatant attempts to alter the demographic landscape of Indian Illegally Occupied Jammu and Kashmir (IIOJK).
She said by grabbing land and properties under various pretexts, the Indian government is settling non-locals in the region, effectively displacing Kashmiris from their ancestral homeland.
This is a clear attempt to change the region’s demography, a tactic reminiscent of Israel’s treatment of Palestinians, she mentioned.
She emphasizing that the Modi regime’s actions are a blatant attempt to suppress the Kashmiri people’s right to self-determination.
The Indian government’s policies, including the revocation of Article 370 and 35-A, have led to widespread human rights abuses, arbitrary detentions and a complete disregard for the Kashmiri people’s aspirations, she added.
The international community must take notice of these egregious human rights violations and pressure the Indian government to respect the Kashmiri people’s rights and resolve the dispute in accordance with UN resolutions, she concluded.

Trial of civilians in military courts; SCP continues hearing

Trial of civilians in military courts; SCP continues hearing

ISLAMABAD, Jan 10 (DNA): Additional Attorney General Amir Rahman has informed the Supreme Court that around 5000 individuals are accused in May 9 riots. The 105 individuals, tired in the military courts were those whose presence was proven with undeniable evidence at the places attacked.

The seven-member Constitutional Bench of the Supreme Court, headed by Justice Amin ud Din Khan continued the hearing for the fourth consecutive day and adjourned the proceedings for Monday January 13.

Other Members of the bench include Justice Jamal Khan Mandokhail, Justice Muhammad Ali Mazhar, Justice Hasan Azhar Rizvi, Justice Musarrat Hilali, Justice Naeem Akhtar Afghan and Justice Shahid Bilal Hasan.

Counsel for the Ministry of Defense Advocate Khawaja Harris continued to argue before the Court in defense of the Military Courts in the guidance of questions raised by the Court.

Justice Musarrat Hilali asked the Counsel to inform the Court who writes judgements in Military Courts? ‘It is said that the officers who conduct the proceedings, send details to another office for writing a judgement. How can an officer write a judgement when he was not part of the proceedings?

Justice Naeem Akhtar Afghan remarked that it is commonly supposed that the procedure of trial in military courts is different. Tell us about the various stages of the trials in military courts with a precedent of some actual trial.

The Defense lawyer Khawaj Haris said that he will explain the procedure of the military courts in the second part of his arguments. However, the JAG Branch of the Army is properly consulted by the Commanding Officer before delivering a judgement. Army Act is a special law and procedure under a special law is different from the common law.

Justice Jamal Mandokhail remarked that there is a difference between the laws of army and the country. The Constitution protects fundamental rights of all citizens and the law has reasonably explained this. Referring to his experience as lawyer in appeals against the judgements of the military courts in Baluchistan High Court, Justice Mandokhail said that military courts allows the accused to appoint a lawyer of his choice and the proceedings are almost the same as in other courts.

Justice Hasan Azher Rizivi remarked that an officer is provided to the accused as friend to guide and facilitate him. Trial includes arguments of the lawyers and cross questioning of the witnesses. The only difference is that the judgement is delivered by an officer instead of judge.

On a question by Justice Musarrat Hilali regarding hijacking of the Army Chief Aircraft in 1999, Khwaja Haris replied that the accused of hijacking was not onboard but still he was convicted.

The court adjourned further proceedings to be held on Monday January 13.
