HOW TO FORGET THE CRUEL 5th AUGUST

ALI SUKHANVER

Abrogation of the articles 370 and 35-A, in Indian illegally Occupied Kashmir has altogether changed the demography of the Jammu Kashmir Valley. The helpless people of the Jammu Kashmir valley, who were already in trouble at the hands of the Indian troops, now are in a state of more pain and more agony. They are deprived of their liberty as well as of their identity. The article 370 allowed the state of Jammu Kashmir a certain amount of autonomy – its own constitution, a separate flag and freedom to make laws. Foreign affairs defence and communications remained the preserve of the central government. This article allowed the people of the valley to make their own rules relating to permanent residency, ownership of property and fundamental rights. The article 370 also barred Indians alien to the state from purchasing property or settling there. Most of the Kashmiris are of the opinion that the BJP ultimately wants to change the demographic character of the Muslim-majority region by allowing non-Kashmiris to buy land there. BBC said in an analysis, “Kashmir will no longer have a separate constitution but will have to abide by the Indian constitution much like any other state. All Indian laws will be automatically applicable to Kashmiris, and people from outside the state will be able to buy property there.” The government on the other hand has an altogether different point of view that this step has been taken in benefit of the people of the valley and it will bring a lot of development to the region.

When the Article 35A was in practice, it allowed the legislature of Indian-administered Kashmir to define the state’s permanent residents. It was applied to all of Illegally Indian-Occupied Kashmir, including Jammu and Ladakh, says a report. All identified residents were issued a permanent resident certificate, which entitled them to special benefits related to employment, scholarships and other privileges. But the biggest advantage for permanent residents was that only they had the right to buy and own property in the state. Both these laws were formulated somewhere in May 1954 and it was decided that all those who were living in the state that time and those who have lived in the state for 10 years anytime since, would be ranked  as permanent residents. In short this special status of Jammu and Kashmir had been a continuous pain in the neck of BJP since long. The BJP leadership was all time planning to snatch away that special status from the distressed people of Kashmir; so ultimately the ‘leadership’ did it. Situation after revocation of these articles is so horrible that no one from the outside world even can guess the severity.

NDTV’s correspondent Nazir Masoodi said in a report expressing his feelings of fear and uncertainty a night before revocation of these articles. “It was the most tense and uncertain night of our life. Troops were in every nook and cranny to impose a tough curfew. Before midnight, a complete communication blockade was enforced. Mobile phones, the internet and even landlines were snapped. All the security measures were in place to quell any public revolt. A massive troop buildup, contingency orders, the evacuation of non-locals, tourists and Amaranth pilgrims – for us locals, these were ominous signs. The worst fear was that the centre would do away with Article 35A which defined special privileges for permanent residents of J&K in the areas of jobs and land rights. No one had thought that it may well be the end of J&K state, its Constitution and Article 370. Next year in 2020, the same correspondent once again said, “One year on, there is no fear of losing anything – because there is nothing left to lose. The burden of special status is gone. August 5 last year redefined everything for the people of Jammu and Kashmir. Article 370, which enshrined the relationship between J&K state and the union of India for last 70 years, is gone.”

Last year on 4th August, a year after the abrogation of Articles 370 and 35-A, an article of Kaisar Andrabi was published in the Diplomat. The writer said, “All modes of communication were cut off, and the region is still without high-speed internet a year later, causing many difficulties for average Kashmiris. About 7,000 people were arrested before and after August 5, 2019, including nearly the entire mainstream political leadership. Before August 5, 2019, Kashmir was a nominally autonomous region. After August 5, it has become virtually a settler colony in the making. Kashmir thus became an annexed territory where all existing structures, the majority of them Indian-made, were dissolved so they could fit into the vision of India held by the ruling BJP, whose founding fathers were never comfortable with the unique constitutional status of the only Muslim-majority state.”

Abrogation of the Articles 370 and 35-A would severely disfigure the whole of social and economic fiber in the Illegally Occupied Valley of Kashmir which has ever been the worst victim to the Indian atrocities. Reports say that since 1989, over 100,000 Kashmiris have been killed by Indian forces. More than 7,200 people have been murdered in the custody of the Indian Army. More than 11,000 women have been raped by Indian occupation forces. This brutality of the Indian troops has orphaned more than 110,000 children and widowed more than 23,000 women. Now after brutally successful demographic change, situation of law and order would get worse and worse with the passage of time.

While briefing the delegation, Dr. Sania outlined ten major foundation stones laid out under Ehsaas to make the programme transparent, inclusive resilient and results driven. ‘INDIA USING EVERY TACTIC TO CHANGE DEMOGRAPHY OF IOK’

ISLAMABAD, AUG 4 /DNA/ – Tactics to change demographics of the occupied valley which have been a linchpin of the BJP’s Hindu-supremacist agenda in post-August 5 Indian Occupied Kashmir were denounced by speakers at the 15th meeting of Institute of Policy Studies-Working Group on Kashmir (IPS-WGK).

The agenda of the meeting organized by IPS was to discuss Indian attempts to change the demography of Kashmir during the last two years. Among the speakers were Syed Abrar Hussain, former ambassador and vice chairman IPS, Iftikhar Gillani, a senior Kashmiri journalist, Farzana Yaqoob, former AJ&K minister and General Secretary IPS-WGK, Ambassador (r) Tajammul Altaf, senior research associate at IPS, Advocate Nasir Qadri, International Law Expert from Legal Forum for Oppressed Voices of Kashmir (LFOVK), and Naufil Shahrukh, GM Operations at IPS. The session was chaired by IPS Chairman Khalid Rahman.

It was observed during the discussion that under the new laws imposed by the Modi government, domicile certificates are being awarded to a number of individuals from outside the valley as any person who has studied or lived in the region for 15 years is now eligible for domicile. Even the children of Indian government employees who have served in IOK for ten years are eligible to purchase land and properties.

The speakers rued the fact that Indian army and paramilitary forces, which have already illegally occupied tens of thousands of acres of private and public land, have been given legal impunity against usurping and occupying any land which they deem ‘strategic’ under new laws.

Nasir Qadri opined that Urdu is no more the only official language of the valley as the government has added Hindi, Dogri, English and Kashmiri as other official languages. He chastised the government’s action of setting up the Jammu and Kashmir Industrial Development Corporation that can acquire any land in the disputed valley. The corporation, he added, can use the government to invoke a land acquisition law if so needed, placing it above the law as no court can take action against the corporation in this regard.

Commenting on the findings of the former Indian foreign minister Yashwant Sinha-led commission, Concerned Citizens Group, which visited the valley recently, Iftikhar Gillani maintained that the demand for restoration of special status of the valley echoed among the people of Jammu and Kashmir including Ladakh as per the report issued by the commission. He also said that Kashmiris termed the abrogation of Article 370 and 35A as imposition of Hindutva agenda of the Rashtriya Swayamsevak Sangh (RSS) in Kashmir.

The session was told that the Indian government is bringing officers from outside the valley amid very thin representation of Kashmiri Muslims in the bureaucracy to run the government machinery. Moreover, a panel headed by a top police officer will review cases of government employees in the IOK who could be sacked under a law in the Indian Constitution.

Under new laws, applications for government jobs will now undergo harsher scrutiny as applicants are directed to produce a comprehensive ‘satisfactory report’ from the Criminal Investigation Department (CID) for selection.

Regarding the new media policy, the experts said that now a mid-level bureaucrat will decide whether the news is ‘fake’ or passes the government’s test. The new policy, as mentioned by the speakers, will deprive newspapers and publications of government advertisements for non-compliance. Furthermore, several journalists have been booked under an anti-terror law as punishment.

Abrar was of the view that abrogation of Article 370 and 35A was indicative of Indian designs to change the demography of IOK as 1.8 million bogus or fake domiciles have already been issued till February 2021. He emphasized the need for action on part of Pakistan to unveil nefarious Indian designs and show to the world the real face of India.

Concluding the session, Khalid Rahman underscored that the resistance sentiment among Kashmiris still prevails despite coercive actions and a narrative war is going on to create discouragement among the people of Kashmir across the LoC. He perceived the beginning of a new phase of struggle in IOK in the post-August 5 scenario. He warned against Indian designs of opening embassies of foreign countries in the valley to give legitimacy to its claims on IOK, and urged the government of Pakistan to expedite its actions on the diplomatic front.=DNA

PTI’S ABDUL QAYYUM NIAZI ELECTED NEW PRIME MINISTER OF AJK

ISLAMABAD, AUG 4 /DNA/ – Pakistan Tehreek-i-Insaf’s Abdul Qayyum Niazi was on Wednesday elected the 13th prime minister of Azad Jammu and Kashmir.

He received 33 votes in the newly formed Legislative Assembly of Azad Jammu and Kashmir, whereas joint opposition’s candidate Chaudhry Latif Akbar garnered 15 votes.

Niazi succeeds PML-N’s Raja Farooq Haider, whose tenure in the AJK PM’s office had ended on July 30.

Earlier in the day, Federal Minister for Information and Broadcasting Fawad Chaudhry announced that Prime Minister Imran Khan had nominated Niazi as the ruling party’s candidate for the position. In a tweet, the minister said that PM Imran had made the decision after extensive consultations and reviewing all the proposals. “He is a dynamic and genuine political activist and his heart beats for the people,” he said.

Azhar Mashwani, Punjab chief minister’s focal person for digital media, added that Niazi was a member of the AJK Legislative Assembly from border area Abbaspur Poonch.

“He is also the central joint secretary of the PTI,” he said.

Imran Khan had on Friday and Saturday interviewed no less than seven candidates for the position of AJK premier. The prime minister had put various questions to them, relating to their future strategy and views on environment, tourism and national and international issues.

According to a source, PM Imran had expressed displeasure over the fact that he was being contacted by different quarters that were exerting pressure to select particular candidates.

Niazi — who won the recent AJK polls from the LA-18 constituency — was not among the leading candidates for the position initially.

PTI clinches most seats to form next govt

According to the official results of the July 25 polls, the PTI clinched 26 general seats of the AJK Legislative Assembly, followed by 11 by the PPP, six by PML-N and one each by state-based AJK Muslim Conference (AJKMC) and Jammu Kashmir Peoples Party (JKPP).

Three more PTI candidates were elected unopposed on Sunday against five seats reserved for women, in addition to one each from the PPP and the PML-N.

On Monday, the ruling had secured another three reserved seats, raising its strength to 32 in the 53-member house. Following the PTI’s victory, PM Imran had congratulated the successful candidates and thanked the people of AJK for placing their trust in the PTI, which resulted in the PTI’s electoral victory.

“I will focus on bringing the people out of poverty through our Ehsaas and Kamyab Pakistan programmes; and establish accountability and transparency in government,” he had said.

“As an ambassador for Kashmir, I will continue to raise my voice on all international forums including the United Nations to ensure the international community fulfills its commitment of self-determination to the Kashmiri people through a UN-sponsored plebiscite,” he had vowed.

UAE under fire for spying officials, activists in Yemen

The United Arab Emirates (UAE) has reportedly used an Israeli spyware known as Pegasus to spy on most members of the Saudi-backed Yemeni government.

An investigation published last month by 17 media organizations said the Pegasus spyware, made and licensed by Israeli company NSO, was used by the UAE to monitor and spy on the ministers of the internationally recognized government of President Abd Rabbuh Mansour Hadi.

The wiretapping activities reportedly targeted the Yemeni president and his family members, former Prime Minister Ahmed Obaid bin Daghr, former Foreign Minister Abdul Malik al-Mikhlaf, and current Minister of Youth and Sports, Naif al-Bakri.

The list of targets for surveillance also included Information Minister Muammar al-Eryani, former Interior Minister Ahmed al-Maisari, former Foreign Minister Khaled al-Yamani, Director of the Office of the Yemeni Presidency Abdullah al-Alimi and former Transport Minister Saleh al-Jabwani.

Speaking to Anadolu Agency, al-Jabwani said he was “not surprised” by the revelation as he was “expecting such actions from the UAE”.

“The UAE is a rogue police state which engages in all kinds of illegal work such as espionage, organized assassinations, building secret prisons, destroying the social fabric and dividing countries, which all was practiced in Yemen by the UAE,” said al-Jabwani, who served as a transport minister between December 2017 and December 2020.

According to leaks, the Pegasus spyware had been used in attempted and successful hacks of smartphones belonging to journalists, government officials and human rights activists on a global scale.

The UAE has denied the spying allegations, saying in a statement by the Foreign Ministry that “allegations… claiming that the UAE is amongst a number of countries accused of alleged surveillance targeting journalists and individuals have no evidentiary basis.”

The UAE is a member of the Saudi-led military coalition against Houthi rebels, which launched a massive air campaign against the Shia rebel movement in 2015 to roll back Houthi military gains in Yemen.

The Iran-aligned rebels overran much of Yemen, including the capital Sanaa, in 2014, forcing the Hadi government to flee to Saudi Arabia.

UNDER SURVEILLANCE

Al-Jabwani argued that he “knew from the first day” of his return from Saudi Arabia to the southern city of Aden to exercise his duties as a transport minister in December 2017 that he was “under surveillance by the Emirates and others.”

“I did not care because I had no secrets to hide. I used to go to work in the morning without knowing whether I would return home or not,” he said.

Al-Jabwani said that having his name on the list of targets for surveillance was a “normal act for the UAE” as it considers him a “number-one enemy” because of his stance against the UAE practices in Yemen.

“From the first moment of my work in the transport ministry, I expressed my views against the UAE frankly and publicly. Spying on us shows the devil nature of this country,” he opined.

Observers believe that the UAE started to spy on Hadi’s government after their dispute on the formation of the UAE-backed Southern Transitional Council (STC) in May 2017.

The dispute was triggered by Hadi’s dismissal of STC leader Aidarus al-Zoubaidi from his post as Aden governor.

“The UAE spies on everyone in Yemen, including Saudi Arabia, the legitimate government and leaders of its Yemeni ally, the STC,” Abdulsalam Muhammed, chairman of Abaad Studies and Research Center, told Anadolu Agency.

Since the UAE has its own strategy to control large parts of Yemen, “spying provides it with a lot of information about the government’s plans regarding military and political resolutions to normalize the situation in the liberated areas that might jeopardize the UAE’s interests in the south,” he said.

Over the past six years, the UAE has pursued an ambitious strategic agenda in the Red Sea, building military installations and securing control of Yemen’s southern coasts along the Arabian Sea in the Bab al-Mandab Strait and Socotra Island.

Muhammed claims that Abu Dhabi has “obstructed state projects” aimed at achieving economic and political stability in Yemeni areas liberated from Houthi rebels.

YEMENI SILENCE

The Yemeni government has yet to comment on the UAE spying allegations.

Al-Jabwani, however, believes that the government is “not going to make any comments on this issue”, claiming that Yemeni Prime Minister, Muin

Abdul Malik, is “participating in a similar program with the two countries of the Saudi-led coalition”, in reference to the UAE and Saudi Arabia.

Similarly, Muhammed said it is “not surprising that the government did not comment on this matter” as it has not made statements on other major issues.

“The government knows that this issue is much related to the UAE’s relationship with Saudi Arabia, so it does not want to trap its main supporter, the Saudis, in the corner and prefers to be silent,” he opined.

As a consequence of this spying activities, the Yemeni government is “supposed to announce the end of the UAE’s presence in Yemen”, Muhammed said, but due to its “uselessness and lack of sovereignty, the government cannot comment on this matter.”
