Military trial of civilians: Defence ministry files appeal against SC verdict

ISLAMABAD: The government has approached the Supreme Court with an appeal against the order of a five-member bench that declared the trial of civilians in military courts illegal, reported Geo News on Friday.

In its intra-court appeal, the Ministry of Defence urged the apex court to revoke the October 23 decision and restore the sections of the Official Secrets Act that were declared illegal by the bench. It also urges the Supreme Court to restore Section 59(4) of the Army Act.

The petition has also warned that declaring some sections of the Army Act and Official Secrets Act illegal would harm the country.

The defence ministry’s plea comes a day after the caretaker Sindh government and Shuhada Forum, Balochistan, separately requested the Supreme Court to set aside its judgment declaring unconstitutional the trials of civilians in military courts.

The Sindh chief secretary filed an appeal under Section 5 of the Supreme Court (Practice and Procedure) Act 2023 read with Article 184(3) of the Constitution against the order passed by the apex court in the petitions, challenging the trial of civilians in military courts.

The caretaker provincial government prayed to the apex court to allow its appeal against the October 23 short order.

It further prayed the court to suspend the operation of the short order till the appeal is pending.

On October 23, a five-member larger bench of the apex court headed by Justice Ijazul Ahsen and comprising Justice Munib Akhtar, Justice Yahya Afridi, Justice Mazahir Ali Akbar Naqvi and Justice Ayesha A Malik declared the trial of civilians in the military courts as unconstitutional.

It also held that 103 persons and others who may be placed in relation to the events arising from May 9 and 10 could be tried by criminal courts established under the ordinary or special law of the land.

Pakistan Tehreek-e-Insaf and others have approached the top court against the military trials on the grounds that they lack transparency.

The decision to use military courts was taken by the government of Shehbaz Sharif, who has since completed his term in August and handed over to a caretaker government that will oversee an election slated for January.

Hundreds of Imran Khan supporters stormed military and government installations, and even torched a general’s house, following the former premier’s brief arrest by the Punjab Rangers.

ISLAMABAD: Pakistan said on Thursday that the 75 years of its diplomatic relations with Belgium encompassed the spirit of solidarity and expressed commitment to work with it towards shaping a better world for future generations.

A statement by the Foreign Office said the upward trajectory of bilateral relations was deeply embedded in people-to-people linkages and frequent high-level contacts at the leadership level.

It mentioned that the institution of bilateral political consultation provided a strong foundation for a multifaceted dialogue that holds the potential to deepen this longstanding bilateral relationship.

“The robust trade between the countries has witnessed continuous growth for mutual benefit,” it said.

“The depth of bilateral relations encompasses the spirit of solidarity and support demonstrated during times of need, such as disaster management to mitigate natural calamities,” the FO statement said.

The Joint Communique, issued on November 26, 1947, encapsulates the decision of the two governments to accept respective diplomatic missions ‘to strengthen the bonds of friendship and mutual interest’.

Following the historic decision, the two countries opened diplomatic missions in 1948.

“It is a proud moment, as the goals outlined 75 years ago paved the way for a strong bond of friendship,” the FO statement added.

“The relationship between Belgium and Pakistan is forward-looking, as both countries are committed to working together on multilateral forums to address common challenges, such as sustainable development and climate change, as well as fundamental values such as democracy and human rights, providing strength to these relations,” it said.

KOLKATA : Australia qualified for final of the World Cup 2023 after beating South Africa by three wickets in a nail-biting contest at Eden Gardens, Kolkata, on Thursday.

Aussies achieved the modest target of 213 runs in 47.2 overs, to reach final for eighth time. Proteas bowlers gave a tough time, slimming the opponent’s chances for win, but tail order of Australia held the nerves to clinch the crucial victory.

Travis Head and David Warner made a sparkling start to the chase, cutting into Kagiso Rabada and Marco Jansen in the first six overs, racing to 60/0. But Australia’s serene progress came to an abrupt halt as the spinners kept the game alive.

The introduction of Aiden Markram gave South Africa initial hope as he struck with his first ball to remove Warner for 29. And a terrific grab from Rassie van der Dussen off Kagiso Rabada saw Mitchell Marsh depart without scoring.

Steve Smith made 30 off 62 while Marnus Labuschagne and Glenn Maxwell were dismissed in quick sessions. After Josh Inglis removed for 28, Pat Cummins and Mitchel Starc managed to save the wicket and win the game for their side.

Earlier, a magical bowling spell from Aussies restricted South Africa from building a big total as the Proteas were bowled out for 212 in semi-final.

Mitchell Starc struck with the new ball and accounted for the South Africa skipper Temba Bavuma for a duck in the very first over.

And when Quinton de Kock tried to take on Hazlewood in the sixth over, he ended up ballooning a catch towards the mid-on region.

Later, Markram was dismissed while trying to pierce through the point, and van der Dussen fell in the very next over when he edged one to the second slip. South Africa were four down for 24 before rain arrived to halt play.

After the top order collapsed, Heinrich Klaasen and David Miller tried to fight back and build a strong middle-order partnership. But Travis Head got the breakthrough by dismissing Klaasen for 47.

Miller smashed a splendid and much-needed ton to boost the total but he got a little support from fellow players.

Mitchell Starc and Pat Cummins claimed three-wicket haul each while Josh Hazlewood and Head took two wickets each.

Australia will now lock horns with India in final, scheduled for November 19.

Nawaz recalled that the PML-N was not ready to form a government in 2022, but saving Pakistan from default became a priority.

LAHORE: Nawaz Sharif – who has served as prime minister thrice – on Thursday said Pakistan would have progressed and much better placed at a rapid speed, if the policies initiated by his government in 1990s were implemented without any interruption. 

Addressing a gathering at the Lahore Chamber of Commerce and Industry, he recalled that India had copied the policies introduced in 1990s – the first of his three tenures – and attained economic growth.

The then PML-N government helped businesses get rid of the vicious bureaucratic circles, Nawaz said about the trade liberalisation he had brought in Pakistan, which, he added, boosted the country’s national exchequer.

Other countries of the world too passed through the same phases, he noted with reference to the transition from a planned government-controlled economy to free market where the people have freedom to invest according to the needs and profitability while generating competition.

“We understand the economic hardships being faced by Pakistan,” he said, adding that rescuing the people from the current record-breaking inflation and poverty was their responsibility. 

“It is their right if the people demand development, [if they] demand education and health. The government is responsible for providing these services,” the three-time prime minister stressed.

Nawaz recalled that the PML-N was not ready to form a government in 2022, but saving Pakistan from default became a priority.

The resignation speech by Shehbaz Sharif, who was leading the ruling coalition, had been prepared, which checked himself, he told the audience – a development that didn’t happen but widely reported at that time.

“We develop the country, [and] then face exile and imprisonment too,” Nawaz said about his repeated experience.

He noted, “We had committed injustices against our parliament and prime minister ourselves” and “then handed over the country to someone else” – a clear reference to those who deposed him and brought the PTI chairman into power.

The rupee, the economy, the entire system had been ruined as a consequence, which resulted in a fivefold increase in prices, he mentioned. The electricity consumer receiving a Rs1,000 monthly bill during the PML-N government was currently getting Rs15,000, the PML-N supremo added.

Nawaz said Pakistan jumped in ranking and was placed 24th among the world’s economies during 2013-17. “We kept the dollar [exchange rate] at Rs104 for four years,” he said and added that the dollar would have been available for Rs40 or Rs50 if his government policies were not interrupted.

About the nuclear tests conducted in 1998, he said the Muslim nations had started trusting Pakistan as their custodian after he resisted the pressure and decided to go ahead the move, but the things went wrong since then and the country was begging for $1 billion. 

The current state of affairs was a product of “the poor decisions that we took ourselves”, as “we shot ourselves in the foot”, he remarked.

Nawaz also mentioned that the policy [interest] rate during his government was 6 per cent only, which had reached 22pc. “Who can do business with such a high policy [interest rate]?” he questioned.

ISLAMABAD: Pakistan Thursday once again asserted it has not sold arms to Ukraine or Russia, refuting claims made by the British Broadcasting Corporation (BBC) in its recently published investigation. Addressing the Foreign Office’s weekly media briefing today, spokesperson, Mumtaz Zahra Baloch, said: “We are not even in a position to tell which side is using which weapon in this conflict.” She added that the arms sold by Pakistan to anyone have an end-user certificate. Earlier this week, BBC Urdu claimed to be in possession of documents that purportedly show Pakistan’s arms sale to Ukraine, an allegation that the Pakistani government has been consistently rejecting. In its report, BBC Urdu stated that the former army chief General (retd) Qamar Javed Bajwa addressed the passing-out parade of the British Royal Military Academy on August 12, 2022. As he saw the Pak-UK relations touching “historic heights”, a British military cargo plane landed at PAF Base Nur Khan in Rawalpindi. In future, the plane would land at the same base for five times.

The report says that each time, the plane flew from Nur Khan Airbase to the British military base in Cyprus, Akrotiri, and then to Romania, at a time when Russia was waging war in Romania’s neighbouring country, Ukraine. Meanwhile, during the presser, the spokesperson informed about a meeting being currently held between Pakistan and Russia to prevent counter-terrorism. “Additional Secretary Haider Shah is leading the delegation from Pakistan.” Based on intelligence pertaining to the matter, FO said that the Tehreek-e-Taliban Pakistan (TTP) is in contact with illegal residents in Pakistan. The spokesperson also spoke about Pakistan repeatedly asking the Afghan interim set-up to take action against TTP hideouts in their territory, which it said are used for attacks on Pakistan.

“We have asked Afghanistan to take action against these bases,” Baloch said. Last week on November 8, Caretaker Prime Minister Anwaar ul Haq Kakar asked the Afghan government to take action against TTP hideouts and training centres in Afghanistan, urging it to ensure that “they must not be used against Pakistan”. When asked if Pakistan itself would take action against these hideouts in Afghanistan, Kakar said: “We are hopeful that they [Afghan government] will take an action themselves, which is in their own interest and also in our interest.”

Baloch gave a round-up of Pakistan’s presence at the Organisation of Islamic Cooperation’s (OIC) joint Extraordinary Session in Riyadh on November 11, during which PM Kakar condemned the ongoing Israeli aggression in Gaza. “The caretaker prime minister demanded an immediate ceasefire in Gaza and expressed solidarity with the Palestinian people,” she said. The spokesperson added that the premier stressed the resolution of the Palestine issue according to the UN resolutions in the meeting with OIC members. Baloch said Pakistan welcomed the OIC-Arab League Joint Summit declaration. “We call on the international community to stop Israeli attacks on hospitals in Gaza.” Baloch also revealed that Pakistan has been elected to the United Nations Educational, Scientific and Cultural Organisation’s Executive Board for the year 2027 and aims to establish connectivity in all regions.

ISLAMABAD: The Supreme Court of Pakistan has lamented that the violence continued to be perceived as a permissible means to attain one’s goals as evident from the May 9 incidents. The remarks made by Chief Justice of Pakistan (CJP) Justice Qazi Faez Isa came as a three-member Supreme Court bench, headed by the CJP, and comprising Justice Athar Minallah and Justice Aminuddin Khan, heard a review petition filed against the SC’s 2019 judgement in the Faizabad sit-in case. Following Wednesday’s court proceedings, the government announced a three-member commission to identify those who planned, financed, and supported a sit-in at Islamabad’s Faizabad area six years back—a dharna that had brought a little-known religious party, the Tehreek-e-Labbaik Pakistan (TLP), into the national spotlight.

According to the government’s notification, the commission will also recommend legal action against the planners and executors of the protest which disrupted lives in the twin cities Rawalpindi and Islamabad between November 6 and November 27, 2017. As a result of the protest, the PML-N government had to sack its law minister Zahid Hamid. The Supreme Court had taken suo motu notice of the sit-in on November 21, 2017.

Later, a division bench led by Justice Qazi Faez Isa on February 6, 2019 unveiled its verdict in the sit-in case, criticizing the role of intelligence agencies in the saga. Soon after assuming office of the chief justice of Pakistan (CJP) in September this year, Justice Isa listed for hearing the petitions that had been filed against the SC’s February 2019 verdict.

RCCI delegation calls on Hannu Ripatti, Ambassador of Finland

Rawalpindi: A delegation of Rawalpindi Chamber of Commerce and Industry (RCCI) headed by President RCCI Saqib Rafiq called on H.E.  Hannu Ripatti, Ambassador of Finland in Islamabad. Matters related to enhancing bilateral trade, investment opportunities, exploring non-conventional sectors, facilitation under SIFC, cooperation and connectivity, sector specific information sharing, waste management and recycling, networking and tourism came under discussion.

Talking to the delegation, ambassador Hannu Ripatti said that Finland has a strong desire to strengthen trade ties with Pakistan and to do more business activities in a better way and through Fin Partnership which can facilitate and help imports and exports in both ways. Ambassador while accepting the invitation to visit RCCI said that he was planning to visit various chambers of commerce and industries aiming for better connectivity and cooperation. “Finland reopened its mission in Pakistan after the closure of 10 years, “he said.

The ambassador mentioned that a temporary location at the Serena Business Complex was being used but “soon will have the old premises and start routine operations”, including the issuing of visas. He said that the Business Council of Finland will host a business summit in Pakistan in February 2024 and related information will be shared with the chamber of commerce.

While answering to a question, he mentioned that a large number of Pakistani students were pursuing their studies in Finland; however, students were facing problems as they do not have longer-term visas for which applications have to be forwarded to Abu Dhabi which takes time.

RCCI President Saqib Rafiq who also has the portfolio of Chairman Rawalpindi Waste Management Company (RWMC) discussed scope and opportunities in waste management, recycling the waste and energy from the waste.

Senior Vice President, Muhammad Hamza Sarosh, Vice President Faisal Shahzad, executive committee members Abdul Rauf, Mudasir Maqbool were also present in the meeting. —

India broke New Zealand’s jinx to qualify for the finale of the World Cup 2023, inflicting a 70-run defeat on the Kiwis in a semi-final at the Wankhede Stadium in Mumbai on Wednesday. 

The Blues will now lock horns with the winner of the second semi-final between South Africa and Australia on November 19 in Ahmedabad.

Virat Kohli scored a record-breaking 50th one-day international hundred and Mohammed Shami took seven wickets.

Kohli made 117 to surpass the ODI century record he had shared with India great Sachin Tendulkar, and Shreyas Iyer clubbed a rapid 105 in a commanding total of 397-4.

New Zealand were then dismissed for 327 despite Daryl Michell’s 134 with paceman Shami taking a sensational career-best 7-57.

In Sunday’s final, India will face either Australia or South Africa who play their semi-final on Thursday.

As of Shami, he has taken the World Cup by storm ever since he was included in the playing XI and took a seven-wicket haul today that helped his side break the crucial partnership that was taking the Kiwis to victory.

India started off brilliantly as they began their defence of a 398-run target with Shami removing both the openers in his first two overs.

However, after losing two early wickets skipper Kane Williamson and Daryl Mitchell formed a 184-run partnership and brought the 2019 World Cup runner-ups back in the game and were looking all set to stay at the crease for long.

Williamson was dropped on 52 by Shami in the 29th over but the right-handed pacer covered up for his mistake and removed the Kiwis’ skipper just after he was given the ball in the 33rd over.

Shami continued to strike and removed the new batter Tom Latham as well. The wickets continued to fall for the Williamson-led unit and soon they were all-out for 327 runs.

Mitchell top-scored for the losing side with a valiant knock of 134 off 119 deliveries that included nine fours and seven sixes.

Batting first, India were off to a powerful start, as usual, courtesy of Rohit Sharma’s power-hitting in the powerplay as The Hitman scored 47 off 29 deliveries with eight boundaries which included four maximums.

Shubman Gill capitalised on the rapid start provided by the 36-year-old as he continued the charge against New Zealand pacers. The youngster built a formidable partnership with Virat Kohli as he was on his to completing a century but he had to walk back to the pavilion due to cramps leaving India 164-1 in 22.4 overs.

The Blues had no intention to stop and it looked like they came with the mindset of scoring almost 400 runs and that is exactly what they did. Kohli and Shreyas Iyer formed a 163-run partnership and cruised their side to a dominant position in the game.

The Wankhede Stadium roared with fans screaming at the top of their lungs in the 42nd when Kohli played a shot towards the deep back square leg and ran twice between the wicket creating history. The 35-year-old scored his 50th ODI century, overtaking the legendary Sachin Tendulkar for most centuries scored in 50-over cricket.

Kohli departed after scoring 117 off 113 but Iyer continued to score big and eventually ended up scoring his successive ton in the World Cup, he contributed 105 runs off just 70 balls.

KL Rahul played a rapid knock scoring 39 off 29 with seven boundaries at the end and took his side’s total to 397 in the allocated overs.

LAHORE, Nov 15 (DNA): Babar Azam has decided to step down as all-format captain of the Pakistan Men’s cricket team in the aftermath of the poor performance of team in the ICC Men’s Cricket World Cup 2023 in India under his command.

According to a PCB press release on Wednesday, Babar Azam was offered to continue as Test team captain by the Chairman PCB’s Management Committee to which the maestro batter declined and expressed his desire to continue to serve as a batter in all formats for the team.

The PCB press release said, “PCB Chairman Management Committee Zaka Ashraf and Babar Azam met at the PCB headquarters in Lahore today and had a cordial meeting to discuss various aspects and the World Cup performance. Babar was asked to continue as Test captain, while he has been relieved of captaincy in white-ball cricket for him to focus on one format.

After consultation with his family, Babar decided to step down and PCB stands behind his decision.”

PCB respects his decision and continues to support him as a player.

Chairman PCB Management Committee Zaka Ashraf said: “Babar Azam is truly a world-class player and we want him to continue to thrive as a player. He is one of the best batters Pakistan has ever produced. He is our asset, and we will continue to support him. His batting prowess is a testament to his dedication and skill. He is a role model for the present generation.

“We want to see him grow as a great batter and now without his additional burden of the captaincy, he can focus more on his performances to reach even greater heights. We respect his decision and will continue to back him.”

Babar has featured in 49 Tests and scored 3,772 runs which includes nine centuries and 26 half-centuries.

Similarly, the PCB has also decided to appoint new coaching staff for the upcoming test and T20I series in Australia and New Zealand.

The PCB further said, “The PCB has changed the portfolio of the entire coaching staff including Director Cricket Mickey Arthur. All coaches will continue to work in National Cricket Academy while PCB will announce the new coaching staff in due course for the upcoming series in Australia and New Zealand.”
