LHC reserves verdict in Punjab CM election case

LAHORE, APR 12 (DNA) — The Lahore High Court (LHC) on Tuesday reserved its verdict on the petition filed by Leader of the Opposition in the Punjab Assembly and PML-N leader Hamza Shehbaz for convening the assembly’s session for the election of new chief minister of the province.

Earlier, Barrister Ali Zafar, counsel for PA Speaker Chaudhry Pervaiz Elahi, who is also a candidate for the seat of CM along with Hamza Shehbaz, and Azam Nazir Tarar, PML-N’s lawyer, completed their arguments in the case. 

Addressing parties to the case, Chief Justice of the LHC Ameer Bhatti remarked that whether they reached any conclusion or not, the law would take its course. 

Earlier, Barrister Ali Zafar gave the reference of Article 69 of the constitution and argued that any matter pertaining to the provincial assembly could not be taken up for the hearing by a court. “Similarly, under the Rules of Business the court cannot interfere in the legislature’s affairs,” he said, and added, “Just like the provincial assembly cannot inquire from a court of law as to why some cases are still pending.”

“The Punjab Assembly is a constitutional body whose job is to enact laws,” Chaudhry Pervaiz’s lawyer contended.    

Chief Justice, on the occasion, remarked that the process of submission of nomination papers should be completed a day before the election. “The constitution says that new Leader of the House should be elected as early as possible,” he added. =DNA
